How Long Does It Take to Get a Decision on Your Disability Application
The waiting time is highly variable. How long it takes to obtain Social Security disability benefits depends on what stage the case is approved. The first stages run pretty fast. Once the case is opened, the applicant should be receiving an initial decision within the first three months. This first stage typically includes a medical evaluation coordinated by Social Security itself.
If the decision is not favorable, it is necessary to request a reconsideration within the next 60 days and complete the corresponding documentation. This reconsideration stage also takes about three to four months. Upon reconsideration, the Social Security Administration may reevaluate the case with other doctors, but this is not common. The Agency is obliged to reevaluate the case and it must be a decision independent of the initial decision. However, in practice, the decision under reconsideration tends to confirm the initial decision. This does not mean that there is no opportunity for a favorable reconsideration, especially if the applicant is assisted by an attorney.
If the reconsideration is not favorable, an administrative hearing must be requested within 60 days. Here the waiting period is six to twelve months and in some cases even more. Although this waiting period represents a great sacrifice for the applicant, it is also of great benefit for the preparation of the case. Keep in mind that the first two stages only represent six to seven months and it is difficult to generate a robust medical record in such a short time. Preparation for the hearing is essential and it is at this stage that the vast majority of cases are won with good legal representation.
